Terms of use for the Numismart website and services

1. Introduction

Welcome to Numismart - your online store for collectible coins, banknotes, and numismatic items. These terms and conditions govern the relationship between Numismart (hereinafter referred to as "we", "us", "Seller" or "our platform") and you as a user (hereinafter referred to as "you", "Customer" or "user").

Please read these terms carefully before using our site or making purchases.

2. Definitions

For the purposes of these terms and conditions:

• "Website" - means the Numismart internet site accessible at numismart.bg
• "Services" - means all services provided through the Website, including product sales, delivery, and customer support
• "Products" - means all goods offered for sale on the Website
• "Order" - means a request to purchase Products made by the Customer
• "Account" - means a personal user profile in the Website system
• "Business day" - means any day from Monday to Friday, excluding official holidays in Bulgaria

3. Acceptance of Terms

By accessing and using our website, you agree to be bound by these terms and conditions, our Privacy Policy, and Cookie Policy.

If you do not agree with any part of them, please do not use our site. Continued use of the site after posting changes to the terms constitutes acceptance of those changes.

• Delivery: Arranging delivery through partner courier services

5. Registration and Account

5.1. Creating an Account

To make purchases, you may register and create an account by providing:

• Valid email address
• Password (minimum 8 characters)
• First and last name
• Shipping address

5.2. User Responsibilities

• You are responsible for maintaining the confidentiality of your password
• You must notify us immediately if you suspect unauthorized access
• You are responsible for all actions taken from your account

6. Products and Descriptions

6.1. Product Information

We strive to provide accurate descriptions and photos of products. However:

• Photo colors may vary depending on your monitor settings
• Dimensions are approximate and may have minimal deviations
• Condition of collectible items is described as accurately as possible according to professional standards

6.2. Availability

All products are subject to availability. If an ordered product is not available, we will notify you immediately and offer alternatives or a full refund.

6.3. Authenticity

We guarantee the authenticity of all products. If you have doubts about authenticity, you have the right to return the product for a full refund within 30 days.

7. Orders

7.1. Order Process

1. Select desired products and add them to the cart
2. Review the cart and proceed to checkout
3. Enter or confirm the shipping address
4. Choose a payment method
5. Review and confirm the order

7.2. Order Confirmation

After confirmation, you will receive an email with:

• Order number
• List of ordered products
• Total amount to pay
• Expected delivery date

7.3. Order Cancellation

You can cancel an order free of charge before it is shipped. After shipping, please see the returns section.

7.4. Order Rejection by Us

We reserve the right to refuse or cancel an order in case of:

• Errors in product price or description
• Invalid payment information
• Suspected fraud
• Lack of availability

8. Prices and Payment

8.1. Prices

• All prices are listed in Bulgarian Lev (BGN) or Euro (EUR)
• Prices include VAT where applicable
• Delivery price is calculated separately and displayed before order confirmation
• We reserve the right to change prices without notice (does not affect orders already placed)

8.2. Payment Methods

We accept the following payment methods:

• Bank transfer: Direct transfer to our bank account
• Cash on delivery: Payment upon delivery (additional fee may apply)
• Debit/Credit cards: Visa, Mastercard, Maestro
• Online payments: Through secure payment systems

8.3. Payment Security

All online payments are processed through certified payment providers with PCI DSS certification. We do not store full credit card data on our servers.

9. Delivery

9.1. Delivery Methods

• Econt: To office or to address
• Speedy: To office or to address
• International delivery: Through the appropriate courier (price calculated individually)

9.2. Delivery Times

• Bulgaria: 1-3 business days
• EU: 5-10 business days
• Outside EU: 10-20 business days

Times are approximate and may vary depending on the courier service and location.

9.3. Insurance

All shipments over 100 BGN are sent with insurance for their full value, included in the delivery price.

9.4. Receipt

Upon receipt:

• Check the packaging for visible damage
• If there is damage, note it in front of the courier and contact us
• Keep all packaging until full inspection of products

10. Returns and Exchanges

10.1. Right of Withdrawal

According to the Consumer Protection Act, you have the right to withdraw from the contract without giving a reason within 14 days of receiving the products.

10.2. Return Conditions

To exercise your right of return:

• Products must be in their original packaging
• Must not be used or damaged (except for inspection)
• Must be accompanied by receipt or invoice

10.3. Return Procedure

1. Contact us at info@numismart.bg with the order number
2. Receive return form and instructions
3. Send products back within 14 days
4. Refund is made within 14 days of receiving returned products

10.4. Return Costs

Return costs are borne by the customer, unless:

• The product is defective or damaged
• Wrong product was sent
• Product description does not match reality

10.5. Exceptions to Right of Withdrawal

The right of withdrawal does not apply to:

• Personalized products made to customer order
• Products whose price depends on financial market fluctuations
• Sealed products that have been opened after delivery and cannot be returned for hygiene reasons

11. Warranty

11.1. Legal Warranty

According to Bulgarian legislation, we provide a 2-year legal warranty for conformity of goods with the sales contract.

11.2. Authenticity Guarantee

We provide a lifetime guarantee for the authenticity of all our products. If you prove that a product is counterfeit, we will refund the full amount.

11.3. Complaints

When filing a complaint:

1. Contact us within 14 days of discovering the defect
2. Describe the problem and attach photos if possible
3. Send the product for inspection (costs covered by us for valid complaints)
4. Receive repair, replacement, or refund

12. Limitation of Liability

12.1. Exclusion of Liability

Numismart is not liable for:

• Indirect, incidental, or consequential damages
• Loss of profit or business opportunities
• Damages caused by improper use of products
• Delay or inability to deliver due to force majeure
• Actions or omissions of third parties (couriers, payment providers)

12.2. Limitation of Compensation

In all cases, our maximum liability is limited to the value of the respective order.

12.3. Force Majeure

We are not liable for delay or non-performance caused by circumstances beyond our control, including but not limited to: natural disasters, wars, strikes, pandemics, government restrictions.

13. Intellectual Property

13.1. Copyright

All texts, images, graphics, logos, software, and design on the site are owned by Numismart or licensed for our use. They are protected by copyright and intellectual property laws.

13.2. Prohibited Use

Without our express written consent, it is prohibited to:

• Copy, modify, or distribute content from the site
• Use content for commercial purposes
• Remove copyright or trademark notices
• Create derivative works

13.3. User Content

By posting reviews or comments, you grant us a non-exclusive right to use them for marketing purposes.

15.3. Court Proceedings

All disputes that cannot be resolved out of court are resolved by the competent Bulgarian courts.

16. Termination

16.1. By User

You can terminate the use of our services at any time by deleting your account in the Account Settings section.

16.2. By Us

We reserve the right to terminate or restrict your access in case of:

• Violation of these terms and conditions
• Illegal or unethical activity
• Fraud or attempted fraud
• At the request of a competent authority

16.3. Consequences of Termination

Upon termination:

• Account access is deactivated
• Pending orders are fulfilled or canceled
• Data is stored according to legal requirements

17. Changes to Terms

We reserve the right to change these terms at any time. For significant changes:

• We will publish the new terms on the site
